OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
1. How to Enter the Contest
- The IPAD TAG CONTEST (the “Contest”) being conducted by WXRK (the “Station) will take place on weekdays only starting Monday, March 12, 2012 through Friday, April 6, 2012 at 7:05 AM Eastern Time (the “Contest Period”).
- Listen to WXRK (the “Station”) during the Contest Period for the cue to call. Upon hearing the cue to call (the “Cue”) the ninety-second (92nd) caller to reach the Station at 888-923-0923 and complete their call will win a prize, upon confirmation of eligibility. Upon verification of eligibility, the Station will announce the first name and town of the prize winner. The next successive potential prize winner the following day will be required to repeat the first name and town of the initial prize winner. The Station will continue to air Cues during the Contest Period. The ninety-second (92nd) caller following each Cue will be required to repeat the first name and town of the previous prize winner to be deemed a potential prize winner. In the event that the designated caller does not know the exact first name and town of the previous winner, the designated caller will not win a prize and the Station will continue to receive calls until the next caller correctly repeats the first name and town of the previous prize winner. There will be a maximum of one (1) prize winner per day, for a total of twenty (20) contest winners during the entire Contest Period. Prizes will be awarded pending verification of eligibility.
- The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call. At the time of their call entrants must provide their first and last name, complete address, city, state, zip code, telephone number and date of birth to be eligible to win. In the event the designated caller is not eligible or is disconnected, the next caller will be considered a potential winner. There is no limit to the number of times a listener may attempt to call in to win, but a listener may only win once.
2. Eligibility Restrictions
- The Contest is open to all Station listeners who are 16 years of age or older and who reside in the greater New York City Metropolitan Area of New York, New Jersey and Connecticut. Employees of the Station, its licensee, its parent, subsidiary, and affiliated entities, its affiliated advertising and promotional agencies, participating sponsors, other radio stations in the New York metropolitan area and the members of their immediate families and households are ineligible to participate or win.
- Only one (1) winner per household is permitted in any Station-conducted contest. Persons are eligible to win a prize valued at $50 or more or event tickets valued at $100 or more (per ticket) in a Contest conducted by the Station only once every thirty (30) days and only once every six (6) months if the prize is valued over $600.
- The winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.
- Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements.
3. Prize:
- Twenty (20) prizes will be awarded in the Contest. Each prize is one (1) Apple NEW iPad (16 GB). (Approximate Retail Value (“ARV”): $499.00 each.) Exact iPad color will be select by WXRK.
- No more than the total number of prizes specified in these official rules will be awarded. All prizes or prize certificates may be claimed at the office of the Station at the address below during regular business hours. Prizes won by minors must be claimed by the prize winner’s parent or legal guardian. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner (or the winner’s parent or legal guardian if the winner is a minor) and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
- The winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of the Prize. The prize is awarded as is.
- There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. Selection of Winner
- Decisions of Station management with respect to the Contest are final.
- Twenty (20) potential winners each day during the Contest Period will be selected in accordance with Section 1 of these rules.
- Odds of winning depend in part upon the number and order of phone calls received.
- Winner must listen but need not be present to win.
- Winners (or the winner’s parent or legal guardian if the winner is a minor) must execute and return any required affidavit of eligibility and/or liability/publicity release within thirty (30) days of winning or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. Conditions
- Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
- Participation in the Contest and/or acceptance of prize constitutes entrant’s and/or winner’s (and guest’s, if applicable) permission for the Station or its agents to interview the winner(s) (or guest(s), if applicable), to photograph, film, and record each winner (or guest, if applicable), and to use in commerce and in any media his/her name, address (city and state), biographic information, likeness, photograph, audio or video recording, and/or any statements made by him/her regarding the Station, the Contest, and/or its sponsor(s) for purposes of trade, publicity, or promotion without notice or additional compensation, except where prohibited by law. Each winner (and guest, if applicable) agrees to sign a publicity release confirming such consent prior to acceptance of the prize, except where prohibited by law.
- Participation in the Contest and/or acceptance of prize constitutes entrant’s and/or winner’s (and guest’s, if applicable) agreement to release, discharge, and hold harmless the Contest’s sponsor(s), the Station, its licensee, their respective parent, subsidiary and affiliated entities, their advertising and promotional agencies, prize suppliers, and participating sponsors, and their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns (collectively, “Released Parties”) from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Contest, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery.
- If for any reason this Contest cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Contest, or if the Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate, suspend, or modify the Contest. If the Contest is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.
- The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Contest may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Contest, the Station reserves the right to disqualify that entrant from entering and/or winning future contests and to prosecute and seek damages to the fullest extent permitted by law.
- The Station reserves the right to make changes in the rules of the Contest, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Contest and shall not be required to award a substitute prize.
- The Released Parties are not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
- For the Official Rules, send a self-addressed stamped envelope for receipt by March 12, 2012 to “ iPad Tag Contest – Official Rules,” Attn: Promotions, 92.3 NOW, 345 Hudson Street, 10th Floor, New York, New York 10014. For the names of the prize winners send a self-addressed stamped envelope for receipt by May 6, 2012 to the above address marked “iPad Tag Contest – Winner List.” Official Rules and Winner Lists (when completed) shall also be available during regular business hours at the main offices of the Station.
